Terms of Service.

By creating an account, downloading the Hopfly app, or using our website at hopfly.app, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

If you do not agree, do not use Hopfly. That is the honest version of the usual disclaimer.

You must be at least 18 years old to use Hopfly. If you are between 16 and 18, you may only use the service with the express consent and supervision of a parent or guardian.

By using Hopfly, you confirm that you meet these age requirements and that the information you provide is accurate.

You are responsible for keeping your login credentials secure and for all activity that occurs under your account.

• Choose a strong, unique password and do not share it.
• Notify us immediately at support@hopfly.app if you suspect unauthorised access.
• Do not create accounts on behalf of others without their knowledge.
• You may only hold one account at a time unless we explicitly permit otherwise.

We reserve the right to suspend or delete accounts that violate these Terms or that have been inactive for an extended period.

Hopfly is for sharing and celebrating beer experiences with friends. You agree to use the service in good faith. The following are expressly prohibited:

• Posting content that is unlawful, harassing, hateful, or defamatory.
• Impersonating any person, business, or organisation.
• Attempting to access systems, data, or accounts you are not authorised to access.
• Reverse-engineering, scraping, or copying any part of the Hopfly app or API without permission.
• Artificially inflating hop counts, badges, or leaderboard positions through automation or collusion.
• Using Hopfly to distribute spam, malware, or unsolicited commercial messages.
• Any activity that interferes with or disrupts the service or its servers.

Violations may result in immediate account suspension without notice.

You own the content you post on Hopfly — photos, posts, tasting notes, and corrections. By posting, you grant us a non-exclusive, worldwide, royalty-free licence to display, store, and distribute your content as part of operating the service.

This licence ends when you delete your content or your account, subject to reasonable technical delays.

You are responsible for ensuring you have the right to post any content you upload. Do not post photos or text that you do not own or have permission to share.

Content removal

We may remove or restrict content that violates these Terms or applicable law. We will aim to notify you when we do, unless prohibited by law or safety concerns require otherwise.

The Hopfly name, logo, app design, code, and all associated intellectual property are owned by us or licensed to us. Nothing in these Terms grants you a right to use our trademarks or branding without prior written consent.

The beer barcode database is built collaboratively by the community. Contributions to the database are licensed back to the community under the same open-correction principles.

Hopfly is a social app for tracking and sharing beer experiences. It is not a directive to drink. Nothing on Hopfly should be read as encouragement to drink irresponsibly, drink and drive, or drink in violation of local laws.

Drink water. Look out for your round. Know your limits.

Hopfly is provided "as is" and "as available" without warranty of any kind, express or implied — including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the service will be uninterrupted, error-free, or free from viruses or harmful components. Beer database information (barcode data, brewery details, ABV values) is community-maintained and may contain inaccuracies. Do not rely on it for health or allergy decisions.

To the maximum extent permitted by law, Hopfly and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service.

Our total liability for any claim arising from these Terms or your use of Hopfly shall not exceed €100 or the amount you paid us in the preceding 12 months, whichever is greater.

Nothing in these Terms limits liability for death, personal injury, or fraudulent misrepresentation caused by our negligence, or any other liability that cannot be excluded under applicable law.

By you

You may delete your account at any time from within the app settings. Upon deletion, your personal data will be removed in accordance with our Privacy Policy.

By us

We may suspend or terminate your account at any time if you materially breach these Terms, if we are required to do so by law, or if continuing to provide the service to you is technically or commercially impractical.

We will provide reasonable notice where possible. Sections of these Terms that should survive termination (intellectual property, disclaimers, limitation of liability) will continue to apply.

We may update these Terms to reflect changes in the service, legal requirements, or business practices. For material changes, we will give at least 14 days' notice by email or prominent in-app notification before the new Terms take effect.

Continued use of Hopfly after the effective date constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict-of-law principles.

If you are a consumer resident in the EU, you also benefit from any mandatory protections granted by the law of your country of residence.

Any disputes that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the competent courts of Germany, unless mandatory consumer law in your country requires otherwise.
